Our Commercial Real Estate Group represents banks, insurance companies, pension funds and other institutional and non-institutional lenders as well as cross-section of project owners and developers in a myriad of domestic and cross-border real estate-based financing transactions. Combining our extensive experience with a keen awareness of legal developments in the marketplace, we provide proactive value-added service to our clients.

Among our clients are many lenders based in the US and other foreign jurisdictions who rely on us to provide practical and cost-effective advice when lending on the security of real property in Canada.

Our experience structuring and implementing complex real estate financing transactions includes project lending, land development and builder finance, acquisition financing, insured and non-insured commercial loans and mortgages, condominium construction finance and the full range of realty asset types, including less common types of assets such as golf courses, mortgage portfolios, hotels, amusement parks and casinos. We regularly assist clients in negotiating mezzanine/subordinated debt and other inter-creditor arrangements common to this area of finance.

Well-versed in mortgage and related security enforcement, our lawyers are fully equipped to meet all of our clients’ needs in both good and bad economic times.

We have helped Schedule 1 Banks and other lenders develop standard forms of loan, security and related agreements and documents and establish lending practices and procedures for commercial mortgage and other real estate based lending programs, including the use of title insurance.
